UNDERSTANDING TRUSTS AND THE RELEVANT TAX CONSIDERATIONS
The first part of this session shall focus on the basic principles of trust law in Malta. The discussion shall inter alia focus on the basic features of a trust in Malta and what is required in order to create a trust in terms of Maltese law, the various types of trusts, the concept of fiduciary obligations as well as a high level analysis of the duties pertaining to the different parties associated with a trust.The second part of this session shall cover Malta’s tax regime in relation to trusts from an income tax perspective. The session shall, in particular, cover the general ruleset applicable to the taxation of settlements of property on trust, trust income, trust distributions, transfers of beneficial interest and relevant anti-hybrid considerations.

- Elena Tortell - Elena is a lawyer by profession, having graduated with a Bachelor of Laws Honours (LLB. (Hons.), a Masters of Advocacy (M.Adv.) with the University of Malta and subsequently with a Masters of Law (LLM) specializing in Corporate and Securities Law, having studied with the University of London. Elena has been admitted to the Bar of Malta and the Superior Courts of Malta.Elena is a Manager in the Deloitte Malta Business Tax team focusing primarily on corporate law. In her role, Elena’s primary area of focus within the Malta Business Tax Team consists of the provision of advisory services, and assistance with the implementation thereof, on the corporate implications of domestic and cross-border corporate transactions, with specific focus on group re structurings, transfer of assets and shares, and the use of trusts as a form of asset management vehicle.
- Ian Zahra - Ian Zahra is a lawyer by profession and forms part of the international tax team at Deloitte Malta.Following the completion of his studies in law at the University of Malta, he recently graduated in international tax law from the University of Leiden in the Netherlands and worked as a Teaching Assistant at the International Tax Centre (ITC Leiden).
