THE REMITS OF THE SME DEFINITION VIS-À-VIS TRANSFER PRICING RULES
Micro, small or medium-sized enterprises shall be excluded from scope of the Transfer Pricing Rules (the Rules). According to the Rules, micro, small or medium-sized enterprise means undertakings fulfilling the criteria laid down in Annex I of Commission Regulation (EU) No 651/2014, as in force at the relevant time (the ‘SME Definition’), which could turn out to be a very complex exercise. Therefore ascertaining whether a Company falls within the ambit of the said SME definition is crucial in determining whether a Company falls within the scope of the Rules or otherwise.

- BRENDA WILLIAMS CAFFARI - Brenda is an accountant by profession, joined the tax function of KPMG after graduating with a second class degree in both the B. Com course and the B. Accty (Hons.) course from the University of Malta. Brenda is currently an Associate Director involved in the provision of tax compliance and advisory services to a diversified portfolio of both local and international clients. Brenda also has extensive experience with dealing with clients benefiting from any sort of incentive aid in terms of the incentive legislation regulations and EU regulations. Within this context, she has advised leading local businesses operating in various industry sectors including but not limited to: Aviation, Information Technology, Pharmaceuticals, Manufacturing, Logistics, Waste Management, Building Construction and Hotel & Accommodation. Brenda also delivers lectures in various seminars and professional educational activities relating to taxation matters including taxation modules to students reading for their ACCA qualification.
