PREPARING FOR REQUESTS FOR INFORMATION AND INSPECTIONS BY THE OFFICE OF THE COMMISSIONER FOR REVENUE
Good Governance: preparing for visits and/or requests for information by the relevant Authorities: Local legislation grants the relevant authorities broad powers to carry out inspections on and request information from subject persons, licensed entities and taxpayers, as the case may be. The MIT in collaboration with the MSEI is offering two webinars which are designed for designated non-financial business providers and corporate service providers, and which will give participants insight into the supervisory and/or investigative processes undertaken by the relevant authorities.This first session – Preparing for Requests for Information and Inspections by the Office of the Commissioner for Revenue – focuses on the investigative powers of the Commissioner for Revenue (‘CfR’). The Income Tax Management Act and related local legislation endow the CfR with broad investigative powers. This session is aimed at providing an overview of the relevant legislative provisions (both domestic laws and EU Directives) in this field. During this session, participants will be provided with the relevant tools to understand:
- the powers of the CfR in the context of tax audits; and
- the implications of requests for information raised pursuant to local tax legislation.
With this background, this session will, in particular, examine:
- Articles 10A, 13 and 14 of the Income Tax Management Act, Chapter 372 of the Laws of Malta;
- Rules 4 to 10 of the Cooperation with other Jurisdictions on Tax Matters Regulations, Subsidiary Legislation 123.127;
- Exchange of information provisions in the field of double tax treaty agreements entered into by Malta with other contracting states.
- The relevant features of the Directive on Administrative Cooperation 2011/16/EU as subsequently amended.

- Dr Ian Zahra - Ian Zahra is a lawyer by profession and forms part of the international tax team at Deloitte Malta.Following the completion of his studies in law at the University of Malta, he recently graduated in international tax law from the University of Leiden in the Netherlands and worked as a Teaching Assistant at the International Tax Centre (ITC Leiden).
- Dr Christopher Bergedahl - Christopher is a Senior Manager at Deloitte Malta within the International Tax service line, with a focus on the financial services sector. In 2017 he graduated summa cum laude from the International Tax Center Leiden following which he served as a Teaching Assistant for the Fall Term of the 2017-2018 class. Christopher is warranted to practice in front of the Superior Courts of Malta and is a member of the Malta Institute of Taxation, the Malta Branch of the International Fiscal Association and the Malta Institute of Financial Services Practitioners. Furthermore, Christopher is a member of the Education Committee of the Malta Institute of Taxation and actively contributes to technical working groups.
