BREXIT & MALTA: KEY CONSIDERATIONS FROM A DIRECT & INDIRECT TAX PERSPECTIVE

A WEBINAR JOINTLY ORGANISED BY THE MALTA INSTITUTE OF TAXATION AND THE CHARTERED INSTITUTE OF TAXATION UK ON THE KEY CONSIDERATIONS POST-BREXIT FROM A DIRECT AND INDIRECT PERSPECTIVE IN THE CONTEXT OF MALTA-UK TRANSACTIONS.

Join us for a panel discussion on the key considerations post-Brexit from a direct and indirect perspective in the context of Malta-UK transactions.Our panellists are:

  • Mr Gary Ashford – Tax Partner, Harbottle Lewis LLP
  • Mr Ian Hayes – Consultant VAT Advisor; Chairperson Tax Technology Committee CFE Tax Advisers

During the first part of this webinar, the speakers will discuss the impact of Brexit on the cross-border direct tax treatment of investments and transactions given that the relevant EU Directives no longer apply. Amongst others, the discussion will unearth what to expect now that the UK is not bound by the Anti-Tax Avoidance Directive, the Directive on Administrative Co-Operation and fiscal State Aid constraints. Is the UK expected to diverge in direct tax matters and tax transparency? Can the EU expect an aggressive tax competitor and to what extent can we expect the UK to respect its direct tax commitments under the FTA? The speakers will also discuss the UK’s stance on the tax challenges of the digital economy and comment on whether Brexit impacts direct tax dispute resolution.The second part of the webinar will focus on the indirect tax considerations, specifically VAT, looking at the changes to the treatment of cross-border transactions in goods and services, the change in reporting obligations and issues arising in practice.

  • Gary Ashford (CIOT) -
  • Gary Ashford is a well-known international tax partner, with particular expertise in contentious tax matters. He previously held senior positions at HMRC and leading accountancy firms.
  • Gary is an expert on digital taxation matters, including on IP, crypto assets, blockchain technology and associated matters.”
  • He has particular expertise in complex structures, including trusts and funds both in the UK and overseas, and supports non domicile and international clients in identifying areas of risk in their tax affairs. Gary is an expert on the various overseas tax agreements, international transparency, exchange of information and the increasing need for Substance.
  • Gary has particular expertise assisting clients who need to make disclosures to HMRC or who are under Code of Practice 8 & 9 (COP8 and COP9), or criminal tax investigation.
  • He advises on International Tax issues, the OECD BEPS programme (UK implementation) and the EU Anti Avoidance Tax Directive.
  • He also advises private clients, trusts and corporate clients on a range of complex tax issues such as restructuring, residence, non domicile/remittances, transfer pricing matters, employment and property tax and various other matters including VAT.
  • Gary spends a considerable amount of his time helping high-net-worth and high-profile individuals and their companies on managing tax avoidance dispute issues and tax risks relating to overseas structures. Gary is also advising, in collaboration with our Reputation Protection group, helping individuals protect what is rightfully theirs while at the same time limiting any media exposure.
  • Gary is an author for Bloomsbury and tax lecturer on international tax matters. He is also leads for the tax profession in tax Consultations with HMRC and the Treasury.
  • Ian Hayes (CIOT) - Ian Hayes is a tax practitioner of over 40 years standing, during which time he has advised on all taxes, direct and indirect. His clients have included individuals, global and national corporate entities, charitable bodies, public authorities and government. He chairs the Tax Technology Committee, now PAC of the CFE and is a council member of CIOT.
  • Dr Trudy Muscat (MIT) - Trudy Marie Muscat is a Manager, forming part of the international tax team at KPMG. She primarily assists multi-nationals with the application of Maltese fiscal and corporate law in conjunction with European and international taxation.Trudy graduated from the University of Malta with a Doctor of Laws and went on to pursue a Masters of Laws in International Tax Law at the Vienna University of Economics and Business.
  • Chris Borg (MIT) - Chris is a Certified Public Accountant with extensive experience and expertise in VAT and tax matters.Chris is responsible for the Indirect Tax service line of Deloitte in Malta, leading a team of dedicated professionals providing a wide range of indirect tax advisory and compliance services to the firm’s domestic and international clients.He is the chairperson of the Malta Institute of Taxation’s indirect tax technical committee. Chris is also a lecturer and examiner in VAT and Tax, including acting as examiner for the Association of Chartered Certified Accountants (ACCA) and as moderator of the Advanced Diploma in International Taxation (ADIT) offered by the UK-based Chartered Institute of Taxation (CIOT). Furthermore, as chairperson of the Malta Institute of Taxation’s indirect tax technical committee, he acts as alternate representative on the European Commission’s VAT Expert Group and as representative on the Indirect Taxes Sub-Committee of CFE Tax Advisers Europe.
